Suspected DUI driver over the legal limit

Fresno police say test results confirm Loren LeBeau was drinking and driving less than a week ago when he allegedly hit a family crossing the street.  The accident killed Donovan Maldonado and seriously injured his father and baby sister.  According to police, LeBeau's blood alcohol level was point 0.11.  The legal limit is 0.08.

“.11 is intoxicated.  It's not passed-out drunk, but it is very intoxicated,” said Captain Andy Hall of the Fresno Police Department.

Hall says officers are still investigating the accident.  Some unknowns are why he didn't immediately stop, whether there was a passenger initially with him, and whether his headlights were on.  Hall says there was enough light in the cross walk that LeBeau should have seen the bicyclists.

“This cross walk doesn't have a lot of collisions so indications are that most drivers, 99.9% of them, see pedestrians and stop.  So we obviously believe alcohol played a major factor in this collision,” said Hall.

Meanwhile, LeBeau's attorney says that cross walk is dangerous, especially with a light out the night of the accident.  LeBeau is a father of four and is reportedly still trying to come to terms with the tragedy.

“[LeBeau] is devastated.  It's obvious in talking to him that he's not processing information the way he normally would for a person of his intelligence.  He's just in a state of shock over what's happened,” said LeBeau’s attorney, Jeff Hammerschmidt.

LeBeau is scheduled to be arraigned on August 9th in Fresno County court. 

Jesse Maldonado is in fair condition and his 18-month-old daughter is in critical condition in the hospital.

This is a very tragic story. However the bias envolved with the editor and captain andy hall is appalling. I go through that crosswalk on rollerblades at least 4x a week. Signs are posted for the pedestrians stating that traffic does not stop. Almost 50% of the time when a ped gets to the street edge vehicles will stop ( when they are not suppossed to). 3x i have witnessed collisions because a vehicle has stopped and the car behind him ended up rear ending the stopped vehicle. About 30% of the time the vehicle closest to you will stop but the next lane over another vehicle will go through. This is a VERY dangerous crosswalk in respect to the way MOST vehicles/drivers act when pedestrians are around. Also the trees/shrubs in the center median make it difficult to see the peds in the center until you are right on top of them. So for this Captain Andy Hall to say that 99.9% chance alcohol is the primary factor is completely off base and irresponsible. Good grief i hope the Fresno PD doesnt do ALL their investigations this way. The CITY is partially to blame for the crappy design and unsafe conditions. ( why the heck isnt there a stop light for pedestrians there? Jeez there are 2 stop lights present for SIDE STREET TRAFFIC ON EACH SIDE OF THE CROSSWALK!) The driver is partially responsible because he was over the limit. The father is also partially to blame because he knew cross traffic is not supposed to yield and he should have been more careful. Especially with his kids. If you are in a crosswalk with signs posted stating cross traffic does not stop and a car is coming, GET THE HECK OUT OF THE CROSSWALK! So lets look at the ENTIRE situation before jumping to and printing opinions that are off base.
