Local medical marijuana shops will remain open -- at least for now.
On Thursday, a Fresno County Superior Court Judge continued the hearing on a temporary restraining order against nine marijuana shops in the city.
The City of Fresno wants the shops closed, saying they don't meet a city ordinance that requires they comply with both state and federal law. The catch is that medical marijuana is classified as illegal on a federal level, so the shops can’t comply with the Fresno ordinance.
The hearing was continued because the city didn't provided enough proof that all the defendants in the case had been properly served paperwork.
Assistant City Attorney Doug Sloan said, “The court wants to make sure that we proceed orderly with all the people in the case so no one can object that they didn't have proper notice.”
Sean Dwyer, owner of one of the dispensaries said, “The defense for all the collectives in town were completely ready for today and the only party that wasn't ready was the City of Fresno.
Marijuana shops can remain open until October 8th, when the judge is expected to issue his ruling. If he rules in favor of the City of Fresno, that could lead to an injunction and permanent closure of the shops.
