Spencer Scarber's sentencing delayed again

There is another sentencing delay for a convicted rapist who's accused of taking off during his trial.

Sentencing for Spencer Scarber was delayed following his trial after he went missing. 

Scarber was found last week in Mexico and sentencing was rescheduled in a Fresno County court for Thursday, but was delayed again because of a motion for a new trial.

Defense attorney, Antonio Alvarez said, "This case has a very specific, unique issue dealing with it. It's going to be an uphill battle since the court's made a finding of voluntary absence." 

Scarber is due back in court on April 12th. 

Spencer Scarber's parents and sister were also arrested last week, accused of helping him escape. 

His father, Kyle Scarber, is an assistant chief with the California Highway Patrol and is currently on leave.
