Sex Offender Warning at Fresno Park

We're On Your Side with a warning for parents.

A high risk sex offender has been frequenting a Fresno park. Despite efforts to keep him behind bars, he ends up back on the street.

Marc McDavitt is on parole.

He served prison time for exposing himself to young children.

McDavitt has been arrested in Fresno eight times since June. He was released early.

Many of those arrests occurred at Roeding Park in central Fresno, where he was watching young children.

And after half of the arrests, McDavitt was released within a couple hours or the next morning.

McDavitt’s parole agent is handing out flyers at Roeding Park, to warn people to call police if they see.

Fresno's Roeding Park, with its play areas and attractions for children has become an attraction for one high risk sex offender.

42 year old Marc McDavitt has been ordered to stay away from places where children gather - like parks.

But Fresno police have arrested him at Roeding Park at least three times in the past month.

That's frightening news for parents like Octavia Edwards.

“I know that they hang around. I've had some sit here and watch the kids play all day. And I watch mine, they don't go nowhere by themselves,” Edwards said.

On August fifth, parents noticed McDavitt watching young children in the play area and called 9-1-1.

He was arrested. That was the eighth time he'd been taken to jail since June.

“I wish there was something we could do. Eight times in just a couple months it's excessive to say the least,” said parent and Roeding park visitor Patrick Hescox.

The problem is the Fresno county jail is overcrowded.

And even though McDavitt is on parole, the state won't take him, because of prison realignment.

And that worries victim advocates like Lynne Richard-Brown.

“He's not just high risk, he's active. He's an active sex offender. He's giving us all the warning signs and drawing us a map of his intentions,” said Richard-Brown

Richard-Brown is trying to get the legislature to amend prison realignment. 

Before realignment, McDavitt was sent back to prison for 13 months for parole violations.

After realignment, which took effect in October he spent 85 days in the Fresno County jail.

McDavitt was arrested again on Monday. 

The last we checked, he was still in jail.

Law enforcement officers are trying to figure out some way to keep him locked up to make sure there isn't a new victim.

This is not an isolated incident. In addition to the overcrowding problem caused by AB109, realignment has reduced the amount of time ANY parole violator can serve for a violation from 1 year in state prison to 90 days in county jail (after 1/2 time is assessed). Last month in Southern CA, a paroled child molester on GPS monitoring was tracked to a playground by his Parole Agent (BTW, unlike probation, parole places GPS monitors and enforces Jessica's Law on all sex offenders under their supervision.) He was taken into custody at the park, where parents advised that he had given some of the children quarters and bubble gum. A search of his person revealed a piece of paper in his pocket with the words "groomingyoungteens.com" written on it. He was discovered to be under the influence of methamphetamine. He was released from LA County Jail 3 days later, only to be arrested again last week for allegedly "rubbing-up" against children at a local mall. Because prosecution is unlikely in this case, he is expected to be released early next week. Politicians and their supporters will tell you that stories like these are simply scare mongering. Let me assure you that these type of stories are common place and occur every single day throughout CA since the implementation of realignment this past October. Whether it is a sex offender caught grooming his victims, or a hardened gang member taking part in gang activity, the consequences under realignment are no longer a deterrent. More importantly, offenders are being allowed to remain in the community, causing more harm and creating new victims. These are the facts. This is realignment.

As a society we should kill him no judge or jury is going to protect our children it doesn't make the city money why is these monsters are never accidentally shot in police custody if he is killed il volunteer to be on the jury and will never find the killer guilty time to take our city back god knows corrupt Fresno will do absolutely nothing that does make the city money
